EVIDENCE OF AB
Q. Is it correct that you live at 116 Partick Road?
A. Yes.
Q. How long have you lived there?
A. 8 years.
Q. Did you live there with Kevin Johnson?
A. Yes.
Q. Is Kevin Johnson the father to one of your children?
A. Yes, 7 & 11 month old
Q. He was father to the younger child?
A. Yes.
Q. On the 18th May 2007 did you and Kevin go out from Partick Road to Grindon for the night?
A. Yes
Q. Was anyone at home?
A. No the children were elsewhere
Q. Did you meet with friends?
A. Yes
Q. Was it a pleasant night?
A. Yes
Q. The time you and Kevin left had either of you had any problems or difficulties?
A. No
Q. Was it walk-able to get home?
A. Yes
Q. What time did you get home?
A. Roughly 11.30pm
Q. Did you sit up for a while?
A. Yes
Q. Did either of you have more to drink?
A. Yes

Q. Did you go to bed leaving Kevin downstairs?

Q. When Kevin came to bed did something happen did you hear something, was Kevin in the
bedroom fully dressed?
A. Yes
Q. What did you hear?
A. People shouting, rowdiness
Q. Was the window open?
A. No
Q. Could you hear if was male of female voices?
A. Male from the shout, I was in bed but Kevin was not
Q. Where was he?
A. He had just walked into the bedroom, he heard it as well and reacted by looking out of the
window.
Q. Did he say what he was looking at?
A. No
Q. Did he say anything
A. No, he started to walk down the stairs, I stayed where I was
Q. Where did Kevin go?
A. Out of the front door
Q. Did you see this?
A. No but I heard it, I could still hear rowdiness
Q. Did you look out of the bedroom window?
A. I put my dressing gown on, I could not see anything because of the glare from the light, I can’t
remember hearing Kevin’s voice.
Q. Did the level increase?
A. No
Q. Did you open the window?
A. No
Q. How long were you at the window?
A. 10-15 seconds, I went downstairs I got to my front gate and said I was phoning the police
Q. What were you going to report?
A. My fiancé was being attacked by 2 males, there was 3 altogether, 2 on top of him. Kevin was on
the floor and third male was in the middle of the road.
Q. Where were you?
A. At my gate post
Q. Were you wearing your glasses at that time?
A. No, I am short sighted
Q. So you needed your glasses?
A. Yes
Q. Which direction was the third male?
A. In the junction facing them
Q. Did you stay there?
A. I immediately ran in the house to phone the police
Q. Did you dial the number?
A. Yes
Q. Did you go back outside?
A. Yes I went out with the phone dialling
Q. What did you see?
A. They were running away
Q. Did you see your neighbour?
A. Not until Kevin fell over the wall
Q. What did you mean you saw 2 males on Kevin?
A. They were throwing punches, they were all on their feet
Q. Did you see them running away?
A. Along Palmerstone Road, at the bottom of Partick Road they turned right
Q. When they ran away Kevin had fallen by the wall, did you attend to him?
A. Yes, Marsha was there
Q. What condition was he in?
A. A bad one, when I first reached him he was on his feet, he fell over the was face first
Q. Could you see any blood?
A. Not straight away no
Q. Did you move him?
A. Marsha rolled him over on his back
Q. Was he making any sound?
A. No, he was struggling for breath
Q. Did you hear him say anything before that?
A. Yes ‘if I’ve been stabbed’ or words to that effect.
Q. Did you see or hear him?
A. I was there it was as they ran off and he was walking over the road
Q. Had he said anything apart from that?
A. No
Q. Had you heard any of the 3 men say anything?
A. No
Q. Did the rowdiness continue?
A. I cannot recall.
Q. The ambulance arrived?
A. Yes and the police
Q. The call to the police, you said I think my boyfriend has been stabbed (transcript read) Marsha

A. Yes
Q. You got home didn’t have the children, then went to bed?
A. Yes

A. Yes
Q. What did Kevin do before he went to the window?
A. Walked up the stairs
Q. Was the noise travelling?
A. Yes up the street from Partick road going to the right
Q. It got no better or no worse?
A. Yes
Q. It was boisterous?
A. Yes
Q. No threats or anything to make you believe you were in trouble?
A. No
Q. He went downstairs?
A. Yes
Q. Did he tell you where he was going?
A. No
Q. You did not know what he was doing?
A. I did as soon as he walked down the stairs, I knew what he was doing
Q. You looked out of the window and did not see anything?
A. Yes
Q. From where you are there is a street lamp?
A. Not sure
Q. It’s not very well lit?
A. No

A. Yes
Q. You went outside and saw Kevin with a couple of men on him?
A. Yes
Q. You got a fleeting look and realised there was a fight?
A. Yes
Q. All you got was the impression of a fight?
A. No there was definitely a fight
Q. Kevin was throwing punches?
A. Yes
Q. Was there anything that had occurred when you saw this that could have put Kevin in a bad
mood?
A. We had a silly argument
Q. You went to bed in a hoof?
A. Yes
Q. He was in a mood with you?
A. I don’t know
Q. Did you see any change in the rowdiness when Kevin was at the window?
A. No
Q. Did Kevin say anything when he was at the window?
A. No

A. Yes

A. Yes they left in a group

A. Not sure, I saw punches thrown and do not know who got the better of who

A. No
Q. Has Marsha Newby been a neighbour for long?
A. Yes she is a friend

A. No
