We will be updating the site later today to include news of the appeal. However our role at wronglyaccusedperson.org.uk has never solely been behind the scenes or public awareness but includes more personal support for those concerned. Over the last week, with heightened emotions it is the later which has been our priority in this case.
Wow.. Thank you to each and everyone of you for your messages of support, including those that do not appear on the site.
Apologises for having not acknowledged them sooner but as I’m sure you can imagine, these past couple of weeks have been like riding a rollercoaster! I think it was a week or so before we got over the ’shock’ of the news! Which wasn’t expected until the end of the year.
This is an extremely anxious time, more so for Simon who is in the worst place possible!
Simon’s solicitor, Campbell Malone, recently said, “We are over the most difficult hurdle but there is a lot of work to be done. We have a way to go before we get Simon home.”
So on reflection of that, we are doing all we can to keep our feet on the ground. This is until we receive the next bit of news in the process!
On a personal note we would like to say a big huge thank you to Sandra Lean (& louise) for having highlighted Simon’s case in her book ‘No Smoke’. (A simplified read for anyone who wishes to learn more about ‘the shocking truth about British justice’)
I would also like to personally say thank you to Sandra for giving me the inspiration & courage to get Simon’s campaign back off of the gound! And in more recent times, for just ‘being there’ and ‘being you!’

When I heard the news of your appeal whilst driving I nearly lost control! To hear that news was absolutely amazing and I’m so glad people are fighting so so hard for you, such as Steph, what a truly great person. I am still in the same company, as are Cody, Becky and many others. I for one cannot wait for the day I can meet up with a great lost friend and have a beer to celebrate freedom from the gross injustice that you have endured.

Michael Mansfield joined Simon’s team years ago, not last November as mentioned in the EADT article, he was on the scene even before the BBC doc was made, this is old news.
Simon knows that and so does Campbell Malone, the family, the supporters, everyone who was involved in Simon’s actual campaign when the team was put together….
What we want is the appeal date and when Simon will be free, facts and dates, not sob stories or old news, please….
All of us working to highlight the plight of the wrongly convicted know, without question, the importance of keeping a high profile, and ensuring individuals are not forgotten. Of course, holding the media to accurate reporting is not always possible – no matter how much they promise, there are always bits and pieces they put in or leave out as it suits them.
We all know, too, that pinning down dates, times and assurances is virtually impossible – the system grinds so slowly and unpredictably that even when dates are given, they can be changed at a moment’s notice.
We’re all very, very pleased indeed that Simon’s case has been referred back to the court of appeal, and I’m pretty sure that all of Simon’s friends and supporters will understand that the waiting for those closest to him must be agonising. All that can be done is to keep his story in the public domain, by whatever means possible, to ensure the pressure on “the system” is maintained.
And, of course, we all want to know the appeal date, and when Simon will be free – no one more-so than Simon himself.
I agree completely, the importance of ongoing publicity is indisputable and not something which should be picked up or dropped as the mood suits. For those inside, wrongly imprisoned there is no option to give up, take a break or move on until circumstances are more favourable.
As for sob stories, that is a phrase in my opinion which should be reserved for those who complain without good reason. I have heard and read many both in and out of the media but no one can really complain retrospectively at choices they themselves have made for whatever reason. The only important thing has and always will be what is best for those concerned not personal differences or grievances.
Yes we all want an appeal date, as Sandra says none more so than Simon himself, but we are at the mercy of the system and its processes and no matter how ready we are, the defence team is and Simon is we can’t do or say anything until the CPS takes the next step. Nothing that is except keep the case in public view and support those who really need and deserve it.
As Stephanie has said on the campaigns facebook account, ‘Now is the time for unity’ and I sincerely hope for Simon’s sake that this is what he finds when his conviction is overturned and he is rightly and properly released.

I am fighting to stop my fiance being put on trial for a crime that never occured and which the police, the CPS and the Crown have already proven never occured by the fact that they are suppressing exculpatory evidence that proves his innocence.
They don’t know that I know, they haven’t met me yet and God help them when they do!
I have read through your experience and as an amateur investigator and advocate can see you have been stitched up on circumstantial evidence. You were denied equality of arms in regard to expert witness testimony and forensic reports, you were denied under Article 6 of the Human Rights act 1998 time to conduct a full defence by the judge in regard to her denying time to put up a defence re; forensic material from the prosecution. This is just off the top of my head for heaven’s sake and I’m just a little sprat on the hockey pitch of the judiciary.
That an innocent man in this country can be brought to trial by the state and it’s agencies on the biased, unbalanced poorly investigated case and then convicted by an improperly directed jury is am abomination and undermines the trust and confidence the public should, but no longer has in the authorities that should conduct themselves in a professional manner and should be beyond reproach.

You are not a convicted prisoner but a hostage of the state. No conviction by the state can make an innocent man guilty.
Not even God can or would condemn an innocent man so what makes the state in it’s arrogance think it can make an innocent man guilty?
I will post from time to time and keep in contact with Stephanie and if there are any protests arranged or you get leave to appeal I will make sure I am there.

The very best of luck to both of you, I’m glad to hear that Simon’s case has finally been referred to the appeal courts. It’s about time. I first read about this case years ago, and I only found out today that Simon is still inside. I will be keeping an eye on developments and I hope that genuine justice prevails SOON!!!
I just wanted to add my good wishes and assure you both of my ongoing interest and concern as matters develop further. Its not difficult to realise what a difficult time this is for you both yet, its a time to keep going foward one careful step at a time and try and keep strong.
I think it is only fair to say that Simon has had a huge number of supporters over his 7.5+ years in prison. Even today his website is receiving over 140 hits per day (an official but conservative estimate from http://www.wronglyaccusedperson.org.uk statistics but it is java based and only 1/3rd of internet users have java enabled).
It is heartening to see so many people who have supported him from the early days post messages on his new official website once they have discovered it. A true sign of public opinion when the details of the case are known in a proper perspective rather than how it is portrayed in court yet the jury is supposed to represent the views of the public. Perhaps it would if they knew what we all do now!
Very well done Stephanie, my personal support as always and I know WHEN Simon is rightly freed and can see everything that has gone on outside he will be immensely proud of what you have done and continue to do for him.

A message from Shaun, Simons brother. After attending the court today and seeing Simon for the first time in a long while I can report he looked well and still has that cheeky smile. The court have layed out plans and we are to attend a further meeting in around 8 weeks time. In this period hopefully all parties included will finalise things and Simon’s case will finally be blown wide open.
I’d like to thank all that attended and it was great to see Simon, even if we were suprised he was attending it was a grateful one.
I would also like to thank the supporters of Simon’s case, having read through this site it’s clear that he has many followers and through all the clouded misgivings from different parties the message is clear, we are here to get Simon free and nothing more matters.

We went to visit Simon again today along with his wife Stephanie.
It was a great visit, though the time flew by and we were all left saying at the end, “is that it?”. But then as anyone who has visited an innocent person in prison will know, the time has a habit of doing that and is all too quickly gone. Then as always comes that awful moment when you must stand up, say your goodbyes and leave someone somewhere they shouldn’t be.
Having said that, Simon is looking well, and despite the obvious anxiousness that is brought on by waiting for the forthcoming appeal we had what can only be described as a relaxed, light hearted and positive couple of hours. It was beneficial not only for Simon and Stephanie but also us who very much needed to see the positive side of what we do given how often we have heard of the heart ache over and over again.
Simon has asked us to thank you all once again for your continued support and looks forward to the day that he can say it not only for himself but by himself.

I am the sister of Barry George…(not guilty of the murder of Jill Dando). I am disturbed by your plight, having read the details of the case, before.
There are parallels with his case, also. Forensic science is not God! They are frequently mistaken. We have seen all the cases (and lives) overturned on forensic evidence. Some; like Sally Clark, never recover from the wrongful conviction.
I pray you stay strong, Simon. I will keep up with progress via this site and FB.
When you are released, look out for the extra injustice…no compensation. Barry has been told he has not proven himself innocent! Even tho he was found, unanimously, NOT GUILTY at re-trial.
We all have to stand together.

UK does not comply with the international law standard on compensation, but seems to have set their own rules to put cases outside the compensation limits.
This can only be challenged by a test case being filed by the best specialized lawyers, because the wording of the claim is essential here. I would like to look into this more closely as soon as I have studied the rules and the cases better.

I had another great visit with Simon yesterday.
He asked me to thank EVERYONE for all the continued messages of support! He is doing well and naturally anxious waiting for things to move forward.
Since his case was referred by the CCRC last October there has been an immense amount of paperwork going back and forth. Therefore Simon has had to assimilate an awful lot of imformation and technical/legal references and remain focused.
We hope to have more details as to how things will progress in the very near future and the site will be updated as soon as we have further news.

In Clarke, R. v [2010] EWCA Crim 684 (11 February 2010) the court said:“R v Akhtar (4th October 1999), R v Bagga [2002] EWCA Crim 1049 and R v Curley & Cadwell [2004] EWCA Crim 2395. The matter is summarised in Archbold 2010, at paragraph 7-65, for instance, by reference to Akhtar, where a reference of [2001] Archbold News 2 is given:
“Where the defendant neither gives or calls evidence but has been extensively interviewed, it is of particular importance that the summing-up should at least summarise the main points made by the defendant. Only rarely if ever would a conviction be adjudged safe notwithstanding a failure to sum-up the defence.”
In Curly May LJ put the matter thus:
“It needs to be emphasised and emphasised again that it is the plain duty of a judge summing up a criminal case to a jury to put fairly and sufficiently the defence case. Where [an appellant] has not given evidence, and in addition not called any evidence on his behalf, there is no evidence from the witness box in support of that defence other than such evidence as has been gleaned by one way or another from other witnesses who have been called. Where that [appellant] who has not given evidence has been interviewed in detail and has given an account in interview which is relevant to their defence and which so far as it goes contains their defence, that is evidential material in the way that we have described and it is the duty of the judge, in our judgment, in putting the defence case properly and fairly to make such proper and structured reference in summary to the material in the interviews which constitutes the defence case in the criminal trial.””

Dear Mr Clarke,
I am writing to you regarding Simon Hall / A767 8AC whom is currently being held at Her Majesties pleasure at HMP Kingston in Portsmouth.
Simon was convicted of murdering Mrs Joan Albert in 2003 and was given a life sentence.
He has continued to maintain his innocence and on 14th October 2009 the Criminal Cases Review Commission (CCRC) referred his case to the court of appeal believing his conviction to be “unsafe.”
Simon has served nearly 8 years in prison for another man/s crime and has had to wait for over 7 months, and is still waiting for a date to be set for his appeal to be heard.
It is absolutely outrageous that a public body has been allowed to stall and avoid accountability.
I am therefore contacting you to ask that this matter be looked into at the earliest possible opportunity.

Dear Sir/Madam,
I am writing to you regarding Simon Hall who won the right of leave to appeal against his conviction, on 16th October 2009, following a review into the safety of his conviction by the Criminal Cases Review Commission. (CCRC)
We were not expecting the CCRC to refer Simon’s case when they did, as many other points had yet to be investigated by them.
However, it became apparent after reading the ’statement of reasons’ that not only did they believe Simon’s conviction was “unsafe in law,” following fresh evidence to show the fibres were not a match, but that they were aware “Simon was still in custody.”
A directions hearing was held on 10th March 2010 and a further directions hearing was set for 13th July 2010.
The directions hearing set for 13th July 2010 was vacated, as both sides now appear to be ready.
Simon has been in prison for almost 8 years exactly, including time on remand, and has maintained his innocence throughout.
It has been brought to our attention that the earliest Simon’s appeal may be heard is October 2010.
Whilst we appreciate that the appeal courts operate on a skeletal basis during the summer recess, and only the most urgent of cases are heard during this time, we consider Simon’s case to fall into this category.
We are also aware that other factors, such as diary schedules for all parties, must be taken into consideration.
However, it is 9 months since the CCRC referred Simon’s case and it would appear there have been several delays, for one reason or another.
Therefore in the interest of justice we are asking that Simon’s appeal is heard at the earliest possible opportunity.

Time in Prison
It is 8 years and 4 days since Simon Hall was remanded and subsequently convicted for a murder he could not have committed. He is currently in prison while the real perpetrator walks free.

Billy’s dad here, I think that your site is looking really good and explains the whole case very well and what a travesty of justice your case is.
It must be really heartening for you to know that you have so much support out here.
Hoping everything goes well on 24th and I leave you with the same message that I gave to Billy on every phone call while he was on remand and that is ‘Keep strong and keep your pecker up’.

Just a quick note, first to say congratulations on your marriage, and secondly to say well done, all of you, for all the hard work you have done in getting Simon’s campaign going again.
I talk about your case everywhere I go, and people are still buying the book two years down the line, so your story is still being told. This site can only increase the numbers of people who hear about your plight, and will support your fight for freedom.

We will be updating the site later today to include news of the appeal. However our role at wronglyaccusedperson.org.uk has never solely been behind the scenes or public awareness but includes more personal support for those concerned. Over the last week, with heightened emotions it is the later which has been our priority in this case.

Wow.. Thank you to each and everyone of you for your messages of support, including those that do not appear on the site.
I think it was a week or so before we got over the ’shock’ of the news! Which wasn’t expected until the end of the year.

Apologises for having not acknowledged them sooner but as I’m sure you can imagine, these past couple of weeks have been like riding a rollercoaster!
This is an extremely anxious time, more so for Simon who is in the worst place possible!
Simon’s solicitor, Campbell Malone, recently said, “We are over the most difficult hurdle but there is a lot of work to be done. We have a way to go before we get Simon home.”
So on reflection of that, we are doing all we can to keep our feet on the ground. This is until we receive the next bit of news in the process!
On a personal note we would like to say a big huge thank you to Sandra Lean (& louise) for having highlighted Simon’s case in her book ‘No Smoke’. (A simplified read for anyone who wishes to learn more about ‘the shocking truth about British justice’)
I would also like to personally say thank you to Sandra for giving me the inspiration & courage to get Simon’s campaign back off of the gound! And in more recent times, for just ‘being there’ and ‘being you!’
The day Simon walks free will be one of the biggest days of his life, a momentous day for us all!!
Billy it was through the tragedy of you losing your daughter Annalise, & the events that followed, that our paths crossed.
You set up your site to help support others in her memory.
So it is on this thought that we look to the future…..
The day that we are all gathered together celebrating (& crying) in ‘The Strand’, speechless, ecstatic and in shock as to what to say next…. What an awesome day that will be!!!!
Words fail me when it comes to expressing just how grateful we are for ALL you have done!

When I heard the news of your appeal whilst driving I nearly lost control! To hear that news was absolutely amazing and I’m so glad people are fighting so so hard for you, such as Steph, what a truly great person. Michael Mansfield joined Simon’s team years ago, not last November as mentioned in the EADT article, he was on the scene even before the BBC doc was made, this is old news.
Simon knows that and so does Campbell Malone, the family, the supporters, everyone who was involved in Simon’s actual campaign when the team was put together….
What we want is the appeal date and when Simon will be free, facts and dates, not sob stories or old news, please….

All of us working to highlight the plight of the wrongly convicted know, without question, the importance of keeping a high profile, and ensuring individuals are not forgotten. Of course, holding the media to accurate reporting is not always possible – no matter how much they promise, there are always bits and pieces they put in or leave out as it suits them.
We all know, too, that pinning down dates, times and assurances is virtually impossible – the system grinds so slowly and unpredictably that even when dates are given, they can be changed at a moment’s notice.
We’re all very, very pleased indeed that Simon’s case has been referred back to the court of appeal, and I’m pretty sure that all of Simon’s friends and supporters will understand that the waiting for those closest to him must be agonising. All that can be done is to keep his story in the public domain, by whatever means possible, to ensure the pressure on “the system” is maintained.
And, of course, we all want to know the appeal date, and when Simon will be free – no one more-so than Simon himself.

I agree completely, the importance of ongoing publicity is indisputable and not something which should be picked up or dropped as the mood suits. For those inside, wrongly imprisoned there is no option to give up, take a break or move on until circumstances are more favourable.
As for sob stories, that is a phrase in my opinion which should be reserved for those who complain without good reason. I have heard and read many both in and out of the media but no one can really complain retrospectively at choices they themselves have made for whatever reason. The only important thing has and always will be what is best for those concerned not personal differences or grievances.
Yes we all want an appeal date, as Sandra says none more so than Simon himself, but we are at the mercy of the system and its processes and no matter how ready we are, the defence team is and Simon is we can’t do or say anything until the CPS takes the next step. Nothing that is except keep the case in public view and support those who really need and deserve it.
As Stephanie has said on the campaigns facebook account, ‘Now is the time for unity’ and I sincerely hope for Simon’s sake that this is what he finds when his conviction is overturned and he is rightly and properly released.

Hi Simon,
I am fighting to stop my fiance being put on trial for a crime that never occured and which the police, the CPS and the Crown have already proven never occured by the fact that they are suppressing exculpatory evidence that proves his innocence.
They don’t know that I know, they haven’t met me yet and God help them when they do!
I have read through your experience and as an amateur investigator and advocate can see you have been stitched up on circumstantial evidence. You were denied equality of arms in regard to expert witness testimony and forensic reports, you were denied under Article 6 of the Human Rights act 1998 time to conduct a full defence by the judge in regard to her denying time to put up a defence re; forensic material from the prosecution. This is just off the top of my head for heaven’s sake and I’m just a little sprat on the hockey pitch of the judiciary.
That an innocent man in this country can be brought to trial by the state and it’s agencies on the biased, unbalanced poorly investigated case and then convicted by an improperly directed jury is am abomination and undermines the trust and confidence the public should, but no longer has in the authorities that should conduct themselves in a professional manner and should be beyond reproach.
I have joined your Facebook site and your good and corageous wife’s site and written to her.
Keep strong Simon.
You are not a convicted prisoner but a hostage of the state. No conviction by the state can make an innocent man guilty.
Not even God can or would condemn an innocent man so what makes the state in it’s arrogance think it can make an innocent man guilty?
I will post from time to time and keep in contact with Stephanie and if there are any protests arranged or you get leave to appeal I will make sure I am there.
How about being a listener and quietly try to find out just how many innocent, wrongly convicted men there are with you?

I think it is only fair to say that Simon has had a huge number of supporters over his 7.5+ years in prison. Even today his website is receiving over 140 hits per day (an official but conservative estimate from http://www.wronglyaccusedperson.org.uk statistics but it is java based and only 1/3rd of internet users have java enabled).
It is heartening to see so many people who have supported him from the early days post messages on his new official website once they have discovered it. A true sign of public opinion when the details of the case are known in a proper perspective rather than how it is portrayed in court yet the jury is supposed to represent the views of the public. Perhaps it would if they knew what we all do now!
Very well done Stephanie, my personal support as always and I know WHEN Simon is rightly freed and can see everything that has gone on outside he will be immensely proud of what you have done and continue to do for him.

A message from Shaun, Simons brother. After attending the court today and seeing Simon for the first time in a long while I can report he looked well and still has that cheeky smile. The court have layed out plans and we are to attend a further meeting in around 8 weeks time. In this period hopefully all parties included will finalise things and Simon’s case will finally be blown wide open.
I’d like to thank all that attended and it was great to see Simon, even if we were suprised he was attending it was a grateful one.
I would also like to thank the supporters of Simon’s case, having read through this site it’s clear that he has many followers and through all the clouded misgivings from different parties the message is clear, we are here to get Simon free and nothing more matters.

Like Shaun, I attended the court hearing yesterday and it was good to see Simon’s family and friends there, supporting him in this long long fight. He certainly does still have that cheeky smile! Although we still have some weeks to wait, it is heartening and encouraging to know that the end is at last in sight and the day WILL come when Simon will walk out a free man once more. What a wonderful day that will be. Stay strong Si, and focussed and know that you have such a lot of support from so many people. You are never far from our thoughts.

We went to visit Simon again today along with his wife Stephanie.
It was a great visit, though the time flew by and we were all left saying at the end, “is that it?”. But then as anyone who has visited an innocent person in prison will know, the time has a habit of doing that and is all too quickly gone. Then as always comes that awful moment when you must stand up, say your goodbyes and leave someone somewhere they shouldn’t be.
Having said that, Simon is looking well, and despite the obvious anxiousness that is brought on by waiting for the forthcoming appeal we had what can only be described as a relaxed, light hearted and positive couple of hours. It was beneficial not only for Simon and Stephanie but also us who very much needed to see the positive side of what we do given how often we have heard of the heart ache over and over again.
Simon has asked us to thank you all once again for your continued support and looks forward to the day that he can say it not only for himself but by himself.

Hello Simon,
I am the sister of Barry George…(not guilty of the murder of Jill Dando). I am disturbed by your plight, having read the details of the case, before.
There are parallels with his case, also. Forensic science is not God! They are frequently mistaken. We have seen all the cases (and lives) overturned on forensic evidence. Some; like Sally Clark, never recover from the wrongful conviction.
I pray you stay strong, Simon. I will keep up with progress via this site and FB.
When you are released, look out for the extra injustice…no compensation. Barry has been told he has not proven himself innocent! Even tho he was found, unanimously, NOT GUILTY at re-trial.
We all have to stand together.

UK does not comply with the international law standard on compensation, but seems to have set their own rules to put cases outside the compensation limits.
This can only be challenged by a test case being filed by the best specialized lawyers, because the wording of the claim is essential here. I would like to look into this more closely as soon as I have studied the rules and the cases better.

Dear All,
I had another great visit with Simon yesterday.
He asked me to thank EVERYONE for all the continued messages of support! He is doing well and naturally anxious waiting for things to move forward.
Since his case was referred by the CCRC last October there has been an immense amount of paperwork going back and forth. Therefore Simon has had to assimilate an awful lot of imformation and technical/legal references and remain focused.
We hope to have more details as to how things will progress in the very near future and the site will be updated as soon as we have further news.

I am the wife of a police officer, and we both support you, we know the police are a shambles and corrupt.Why cant they get the right person.We are the parents of Danny Major a police officer set up by other officers for an assault they commited.Unfortunatly for the police we have got proof,that they hid.We will never give up till we clear his name.You will be home soon and I hope one day we will meet you.Our prayers are with you god bless

Simon has again asked that I thank those of you whom have recently left messages. “Thank you”
It is fast approaching Simon’s 8th year of wrongful incarceration and we have already organised something to mark this. Hopefully this will not be needed and by that time Simon will have received JUSTICE and is home where he belongs!

In Clarke, R. v [2010] EWCA Crim 684 (11 February 2010) the court said:“R v Akhtar (4th October 1999), R v Bagga [2002] EWCA Crim 1049 and R v Curley & Cadwell [2004] EWCA Crim 2395. The matter is summarised in Archbold 2010, at paragraph 7-65, for instance, by reference to Akhtar, where a reference of [2001] Archbold News 2 is given:
“Where the defendant neither gives or calls evidence but has been extensively interviewed, it is of particular importance that the summing-up should at least summarise the main points made by the defendant. Only rarely if ever would a conviction be adjudged safe notwithstanding a failure to sum-up the defence.”
In Curly May LJ put the matter thus:
“It needs to be emphasised and emphasised again that it is the plain duty of a judge summing up a criminal case to a jury to put fairly and sufficiently the defence case. Where [an appellant] has not given evidence, and in addition not called any evidence on his behalf, there is no evidence from the witness box in support of that defence other than such evidence as has been gleaned by one way or another from other witnesses who have been called. Where that [appellant] who has not given evidence has been interviewed in detail and has given an account in interview which is relevant to their defence and which so far as it goes contains their defence, that is evidential material in the way that we have described and it is the duty of the judge, in our judgment, in putting the defence case properly and fairly to make such proper and structured reference in summary to the material in the interviews which constitutes the defence case in the criminal trial.””

Dear Mr Clarke,
I am writing to you regarding Simon Hall / A767 8AC whom is currently being held at Her Majesties pleasure at HMP Kingston in Portsmouth.
Simon was convicted of murdering Mrs Joan Albert in 2003 and was given a life sentence.
He has continued to maintain his innocence and on 14th October 2009 the Criminal Cases Review Commission (CCRC) referred his case to the court of appeal believing his conviction to be “unsafe.”
Simon has served nearly 8 years in prison for another man/s crime and has had to wait for over 7 months, and is still waiting for a date to be set for his appeal to be heard.
It is absolutely outrageous that a public body has been allowed to stall and avoid accountability.
I am therefore contacting you to ask that this matter be looked into at the earliest possible opportunity.

Just to keep you all updated regarding Simon’s appeal, I wont go into specifics but it looks like it will be several more weeks, maybe months.

Dear Sir/Madam,
I am writing to you regarding Simon Hall who won the right of leave to appeal against his conviction, on 16th October 2009, following a review into the safety of his conviction by the Criminal Cases Review Commission. (CCRC)
We were not expecting the CCRC to refer Simon’s case when they did, as many other points had yet to be investigated by them.
However, it became apparent after reading the ’statement of reasons’ that not only did they believe Simon’s conviction was “unsafe in law,” following fresh evidence to show the fibres were not a match, but that they were aware “Simon was still in custody.”
A directions hearing was held on 10th March 2010 and a further directions hearing was set for 13th July 2010.
The directions hearing set for 13th July 2010 was vacated, as both sides now appear to be ready.
Simon has been in prison for almost 8 years exactly, including time on remand, and has maintained his innocence throughout.
It has been brought to our attention that the earliest Simon’s appeal may be heard is October 2010.
Whilst we appreciate that the appeal courts operate on a skeletal basis during the summer recess, and only the most urgent of cases are heard during this time, we consider Simon’s case to fall into this category.
We are also aware that other factors, such as diary schedules for all parties, must be taken into consideration.
However, it is 9 months since the CCRC referred Simon’s case and it would appear there have been several delays, for one reason or another.
Therefore in the interest of justice we are asking that Simon’s appeal is heard at the earliest possible opportunity.
